স্বাধীন ত্রিপুরা সংবিধানই ভারতীয় উপমহাদেশের সর্বপ্রথম লিখিত সংবিধান

মহারাজা বীর বিক্রম কিশোর মাণিক্য বিশ্ব রাজনৈতিক প্রেক্ষাপট পর্যবেক্ষণ ও কূটনৈতিক সম্পর্ক স্থাপনের লক্ষ্যে ১৯৩০ সালে বিশ্বের বহু দেশে রাষ্ট্রীয় সফর করেন।

এতে করে তিনি অনুধাবন করতে সক্ষম হন যে, দেশে সুশাসন ব্যবস্থাকে চিরস্থায়ী ও শক্তিশালী করতে হলে একটি পবিত্র সংবিধান প্রণয়ন করা অতীব জরুরি।

এ লক্ষ্যে ১৩৪৯ ত্রিংয়ের বৈসুতে (ত্রিপুরাব্দের নববর্ষের দিনে অর্থাৎ ১লা বৈশাখ, ১৩৪৯ ত্রিং – ১৪ই এপ্রিল, ১৯৩৯ইং) মহারাজা বীর বিক্রম কিশোর মাণিক্য Constitution Drafting Committee গঠন করে একটি রাষ্ট্রীয় আদেশনামা জারি করেন।

এ সম্পর্কে রাষ্ট্রের পবিত্র সংবিধানের [THE CONSTITUTION OF INDEPENDENT TRIPURA 1351 TE (1941 AD)] PREFACE-এ ঊল্লেখ আছে:-

“A royal proclamation for making a constitution was made on the 1st Baishakh, 1349 T.E. (14th April, 1939 AD), which was the new year’s day in the state according to the Tripura Era, must be regarded as a red letter day in its annals.”

Constitution Drafting Committee প্রায় ২ বছর ২ মাস ১৫ দিন যাবত কঠোর পরিশ্রম এবং নিজস্ব বুদ্ধিদীপ্ত চিন্তাধারাকে কাজে লাগিয়ে সংবিধানের খসড়া কপি তৈরির কাজ শেষ করে।

সাংবিধানিক ভাষা হিসেবে বাংলার পরিবর্তে ইংরেজি ভাষাকে অনুমোদন দেয়া হয়। ২০শে আষাঢ় ১৩৫১ ত্রিং, মহারাজা বীর বিক্রম কিশোর মাণিক্য পবিত্র সংবিধান বিষয়ে সর্বশেষ রাষ্ট্রীয় আদেশনামা জারি করে খসড়া সংবিধানটি প্রকাশের অনুমোদন দেন।

সংবিধানটি কখন থেকে কার্যকর হবে এবং কী বিল হিসেবে কার্যকর হবে সেসব বিষয়াবলীও উক্ত আদেশনামায় উল্লেখ করা হয়।

এ সম্পর্কে পবিত্র সংবিধানের [THE CONSTITUTION OF INDEPENDENT TRIPURA 1351 TE (1941 AD)] Order No. 997 (Camp)-এ ঊল্লেখ আছে:-

“Where in my New Year’s Day Proclamation of 1349 T.E. in announcement of certain Administrative Reforms, I promised to my beloved people the early grant of a written CONSTITUTION in accordance with which the Government of Tripura would in the future be conducted.
……….

Now therefore I have the pleasure hereby to order that the annxed Bill be sanctioned, and that it come into forces as Law throughtout the territories of the State with effect from the first day of Sravan 1351 T.E, as “THE TRIPURA GOVERNMENT ACT” or “ACT I OF 1351 T.E.”

পবিত্র ত্রিপুরা সংবিধানটি কোথায় কোথায় (অঞ্চলসমূহে) কার্যকর হবে সে বিষয়ে সংবিধানের PART I-এর Section 1 (Extent and application)-এ উল্লেখ আছে:-

“The provisions of this Constitution shall apply to the whole of the Tripura State and shall come into force with effect from the 1st day of Sravan 1351 T.E. For purposes of this Constitution, “Tripura State” or ‘Tripura” shall mean and include the territories which are, have been, or may at any time be, under the rule of His Highness the Maharaja Manikya Bahadur, Ruler of Tripura (here in after refer to as “His Highness”).”

আধুনিক কল্যাণমূলক রাষ্ট্রে জনসাধারণের জন্য যে সকল মৌলিক অধিকার ও স্বার্থ সংরক্ষণের বিষয়াবলী চর্চা করতে দেখা যায়, তার সবই পবিত্র ত্রিপুরা সংবিধানে রক্ষিত ছিল।

এমনকি বর্তমান ভারতীয় সংবিধানে যেসকল নাগরিক অধিকার ও আইনের কথা বলা আছে, তার অধিকাংশই ত্রিপুরা সংবিধানে উল্লেখিত নাগরিক অধিকার ও আইনের বিষয়াবলীতে মিল খুঁজে পাওয়া যায়।

তাই বহু বিশ্লেষক মনে করেন যে, ভারতীয় সংবিধান প্রণয়নের ক্ষেত্রে ত্রিপুরা সংবিধান অনুসরণ করা হয়েছিল এবং অনেক আইনী বিষয় ত্রিপুরা সংবিধান থেকে হুবহু অপরিবর্তিত আকারে গ্রহণ করা হয়েছিল।

এ বিষয়ে ভারতের ইংরেজি দৈনিক Times of India ২০১৫ সালের ১৮ই জুনে দুইটি ভিন্ন ভিন্ন শিরোনামের একই প্রতিবেদন প্রকাশ করে।

শিরোনাম দুইটি হচ্ছেঃ- “Princely Tripura had a written constitution” ও ‘Princely Tripura’s constitution is older than Ambedkar’s’। দুইটি শিরোনামের একই প্রতিবেদনটি নিম্নে হুবহু তুলে ধরা হলঃ-

The princely state of Tripura had a written constitution which had all the fundamental provisions of the present Indian Constitution. Tripura Law Training Institute and Research Centre director Sangkari Das on Wednesday published the constitution with commentaries, detailing its similarities with the present Constitution.

Tripura law minister Tapan Chakraborty released the book. “The last king of Tripura, Bir Bikram Kishore Manikya, had notified the constitution having 68 articles, seven parts and three schedules in July, 1941. It came into being at least nine years before the Indian Constitution was adopted”, said Chakraborty.

The king’s constitution covers all important provisions and articles of the present Constitution, including The Preamble, gender neutrality, emergency provisions and judicial institutions.

It appears that many things, including terms in the Indian Constitution, were borrowed from the king’s constitution.

“The Tripura king’s constitution had clearly described the provision of disqualification of membership in legislative assemblies for criminal offences in Article 24(i)(e). Later, this provision gets a place in the Representation of People Act, 1951. But still it is not followed properly”, he said. Moreover, even when many countries did not ensure voting rights for women, Article 25(ii) of Tripura Constitution, during the British rule, made it clear that no woman shall be disqualified to be a voter or a candidate for election as member by reason only for her sex, if otherwise qualified, said Chakraborty.

According to Tapas Dey, one of the associates of the Tripura Royal family, King Bir Bikram Kishore Manikya had understood that absolute monarchy would not sustain for long after his visits to Europe and America.

He had a meeting with Hitler before the World War II started. By that time, the Indian freedom struggle had also gained momentum which made him realize that citizens need to be given limited powers to run administration.

“With this background, the king formed constitution drafting committee headed by him in 1939. His visionary zeal and exposure helped him to bring out such an excellent constitution in democratic spirit under monarchy”, added Dey.

While comparing both the constitutions, it appears that not only the articles and provisions, even narration and terms, were similar to the Tripura constitution, Das told the media.

The Tripura Constitution also had ‘interpretation’ provision like that in the present Constitution (Article 367) besides resemblance with the judiciary and executive, council of ministers, chief ministers, khash adalat (high Court) and many more, said Das.

“It is quite astonishing that during the British rule, the Tripura king, in his written constitution, had made a core concept of democracy, which finds its concrete manifestation through the idea of representation”, added Das.

স্বাধীন ত্রিপুরা সংবিধান বিষয়ে ভারতের জাতীয় ম্যাগাজিন ‘FRONTLINE’ ২০১৬ সালের ৫ আগস্টে “King’s Constitution” শিরোনামের একটি প্রতিবেদন প্রকাশ করে, যা নিম্নে তুলে ধরা হলঃ-

On the similarities of the Constitutions of princely Tripura and India.

IN 1939, Majaraja Manikya Bir Bikram Kishore Dev Barman, the last ruler of the princely State of Tripura, promised his subjects a Constitution.

A committee of experts was formed, and the Constitution of Tripura came into force in July 1941. Commentaries on Constitution of Princely Tripura State by Sankari Das is an important book for any researcher or student interested in the history of the hilly State of Tripura.

A striking feature of the book is that it highlights the fact that the conception of a modern constitution took root in Tripura while it was still a princely State.

The Constitution came into force when India was still under British rule and nine years before India’s own Constitution came into effect.

When India’s independence became imminent, the king of Tripura decided to become a part of the Indian Union. On September 9, 1949, the Regent Maharani Kanchan Prava Devi (the king Bir Bikram Kishore Manikya having died in 1947 and his son and heir still a minor) and the Government of India signed an agreement for the merger of Tripura.

Interestingly, the Constitution of Tripura provided for separation of the legislature, the executive and the judiciary, even though it was a monarchy.

Executive authority lay with the king, but the Legislative Assembly, or the Vyavasthapak Sava, could make laws for the whole State, though there were certain limitations on its powers. The judiciary was kept separate, with the king as the ultimate appellate authority.

One of the most striking features of the Tripura Constitution was the Privy Council, or Raj Sava, established to advise and assist the king in matters relating to judicial appeals.

The author points out remarkable similarities between the Tripura Constitution and the Indian Constitution.

For example, Section 11(b) of the Tripura Constitution, which provides for the activities of the Council of Ministers, states: “The Mantri-Parishad (Council of Ministers) shall consist of a Chief Minister and not more than four other Ministers as his colleagues whose actual number shall be specified by His Highness from time to time in his discretion.”

The author points to what she calls the “Parallel provision” in Article 163 (1) of the Indian Constitution, which says that there shall be a Council of Ministers with the Chief Minister at the head to aid and advise the Governor in the exercise of his functions, except insofar as he is by or under this Constitution required to exercise his functions or any of them in his discretion.

The Tripura Constitution also imposed restrictions on the legislature, laying down that no member shall have the power to “move, introduce, interpellate on, or otherwise discuss any matter affecting or relating to the ruling family of Tripura (including the ruler’s near relations) or the personal affairs of the Ruler of Tripura or any other Indian state; the military forces of the state; the Civil List of the Ruler and his household; matters governed by treaties and conventions, and other clauses”.

Interestingly, the list also included “the conduct of any judge of the High Court in the discharge of his duties”.

The author points out the parallel provisions in the Indian Constitution, where Article 211 clearly states: “No discussion shall take place in the Legislature of a State with respect to the conduct of any judge of the Supreme Court or of a High Court in discharge of his duties.”

The book also points out the common privileges guaranteed to the members of the Legislative Assembly by the two constitutions—the most important privilege being freedom of speech while performing legislative duties.

Both constitutions grant immunity to a member from any proceedings in respect of anything said or any vote given by him in the Legislative Assembly.

Though separated by almost a decade, the author observes in conclusion, “many provisions of the Indian Constitution look like a replica of the provisions of the Constitution of Princely Tripura—the purpose is same, even words are same”.

It is worth noting that the framers of both the constitutions had drawn upon the same sources and hence the similarities.

উল্লেখ্য যে, ২০১১ সালের আগ পর্যন্ত ত্রিপুরা রাজ্যের মানুষজন, এমনকি বাংলাদেশের ত্রিপুরারাও জানতেন না যে, ঐতিহাসিক স্বাধীন ত্রিপুরার নিজস্ব লিখিত সংবিধান ছিল! না জানার পেছনের ইতিহাস অনেক লম্বা, যা লিখতে গেলে আরেকটি আর্টিকেল লেখা হয়ে যাবে।

এ বিষয়ে অন্য একটি আর্টিকেলে আলোচনা করাটা ফলপ্রসূ হবে বলে আশা রাখি।

এখানে যেটুকু না বললে নয়, সেটি হল- স্বাধীন ত্রিপুরা রাষ্ট্রটি ১৯৪৯ সালের ১৫ অক্টোবরে ভারত ইউনিয়নে আনুষ্ঠানিকভাবে যোগদানের পরপরই “স্বাধীন ত্রিপুরা” সম্বলিত সকল প্রকারের রাষ্ট্রীয় ডকুমেন্ট, দলিল-দস্তাবেজ, মুদ্রা, ডাক-টিকিট, রিভিনিউ স্ট্যাম্প, রাষ্ট্রীয় গোপন নথিপত্র, জাতীয় পতাকা, সামরিক পতাকা, ত্রিপুরা জাতীয় সঙ্গীতের কপি, স্বাধীন ত্রিপুরার মূল মানচিত্র প্রভৃতি ধ্বংস করে ফেলা হয়েছিল।

ভাগ্যক্রমে মানুষের মাঝে যেটুকু বেঁচে যায়, সেগুলোই আজ আমরা জানতে পারছি। স্বাধীন ত্রিপুরা সংবিধানটিও এমনই এক দুস্প্রাপ্য রাষ্ট্রীয় ডকুমেন্ট, যা ভাগ্যক্রমে মাত্র কয়েকজনের কাছে এর কপি সংরক্ষিত রয়ে যায়।

স্বাধীন ত্রিপুরার লিখিত সংবিধান বিষয়ে সর্বপ্রথম তথ্য তুলে ধরেন বাংলাদেশের বিশিষ্ট গবেষক প্রভাংশু ত্রিপুরা। ২০১১ সালের মার্চ মাসে তিনি “ত্রিপুরা জাতির ইতিহাস ও সংস্কৃতি” নামক একটি গবেষণাধর্মী গ্রন্থ প্রকাশ করেন, যেখানে তিনি ৮৪ পৃষ্ঠার “স্বাধীন ত্রিপুরা সংবিধান”-এর একটি পূর্ণাঙ্গ কপি সংযুক্ত করে দেন।

জানা যায়, “ত্রিপুরা জাতির ইতিহাস ও সংস্কৃতি” গ্রন্থটি দেশ-বিদেশের পাঠক সমাজে দারুণভাবে সমাদৃত হয়েছে, যার ফলশ্রুতিতে প্রভাংশু ত্রিপুরাকে ২০১৩ সালে গবেষণা ক্যাটাগরিতে বাংলা একাডেমী সাহিত্য পুরস্কারে ভূষিত করা হয়।

এরপরই বাংলাদেশের ত্রিপুরারা এবং পরবর্তীতে ত্রিপুরা রাজ্যের মানুষজন (ত্রিপুরা ও বাঙালি) স্বাধীন ত্রিপুরা সংবিধানের বিষয়টি অবগত হন। এরপর ধীরে ধীরে বেরিয়ে আসে নানা ব্যাখ্যা-বিশ্লেষণ। এই ব্যাখ্যা-বিশ্লেষণ আজোবধি চলমান বলে জানি।

আমার ধারণা, তৎকালীন ভারত সরকার “স্বাধীন ত্রিপুরা” সম্বলিত কোন ডকুমেন্ট ও নথিপত্র ত্রিপুরা রাজপরিবারের কাছে সংরক্ষিত করতে দেয়নি। ফলে যা হবার, তাই হল।

ভারতের ইংরেজি দৈনিক Times of India ২০১৫ সালের ১৮ই জুনে ‘স্বাধীন ত্রিপুরা সংবিধান’ বিষয়ে প্রতিবেদন প্রকাশের আগ পর্যন্ত ত্রিপুরা রাজপরিবারও জানতো না যে, স্বাধীন ত্রিপুরা রাজ্যের নিজস্ব সংবিধান ছিল! কারণ, তাদের কাছে “স্বাধীন ত্রিপুরা সংবিধান”-এর কোন কপি সংরক্ষিত নেই।

THE CONSTITUTION OF INDEPENDENT TRIPURA এবং Indian Constitution – এই দুই সংবিধানের মধ্যকার তুলনা করে যে পরিমাণ মিল খুঁজে পাওয়া গেছে, তাতে করে অনেকটা হলফ করে বলা যায় যে, তৎকালীন ভারত সরকার স্বাধীন ত্রিপুরা সংবিধানের মূলকপিটি হস্তগত করে ভারতীয় সংবিধান রচনা করতে Indian Constitution Drafting Committee-এর কাছে হস্তান্তরিত করেছিল। এরপর Indian Constitution রচনা শেষ হয়ে গেলে “স্বাধীন ত্রিপুরা সংবিধান”টি ধ্বংস করে ফেলা হয়।

উপমহাদেশের বিভিন্ন জাতিগোষ্ঠীগুলো যখন যার যার অধিকার আদায়ের সংগ্রামে ব্যস্ত, ধর্ম পরিচয়ে দ্বিধা-বিভক্ত, ইংরেজ শাসনের সূর্য ডুবুডুবু অবস্থা, ঠিক তখনই একমাত্র স্বাধীন রাষ্ট্র হিসেবে ত্রিপুরায় লিখিত সংবিধান প্রণীত হয়েছিল, যা কার্যকর ছিল ভারত ইউনিয়নে অন্তর্ভুক্তির পূর্ব মুহূর্ত তথা ১৯৪৯ সালে ১৪ই অক্টোবর পর্যন্ত।

এই সংবিধানই যে, ভারতীয় উপমহাদেশের সর্বপ্রথম লিখিত আকারে প্রণীত সংবিধান তাতে কোন সন্দেহ নেই। এর চেয়ে গর্বের বিষয় আর কি হতে পারে? যদি আজও ত্রিপুরা স্বাধীন থাকতো, তাহলে এটা নিশ্চিত যে, ত্রিপুরা হতো পৃথিবীর অন্যতম শক্তিশালী ও কল্যাণমূলক রাষ্ট্র।
